  • Due to changes in river ecology and habitat, walleye are moving farther up the Deschutes River. And “this is not good news for salmon and steelhead juvenile migration. Navigability of the Weber River Affirmed by Utah Supreme Court

Navigability of the Weber River Affirmed by Utah Supreme Court

SALT LAKE CITY, UT – In a huge win for public recreational rights, the Utah Supreme Court today affirmed the 4th District Court’s 2015 ruling that the Weber River was used for commerce prior to statehood, and that the evidence of this use was “sufficient to establish navigability of the river where it crosses the property at issue in this case.”  In so doing, the Court affirmed that the river’s beds and banks “where it crosses the property at issue in this case” should be open to lawful public use.

The opinion by the USC represents the culmination of a six and one-half year legal battle brought by the Utah Stream Access Coalition (USAC) against landowners on the Weber River who sought to effectively privatize under the auspices of the ironically-named “Public Waters Access Act” of 2010 (also know as “HB141”), a river that had been used as a “highway of commerce” by the Utah Pioneers.  By asking state and local law enforcement to enforce the Act and by posting no trespassing signs on the riverbank on a bridge crossing the Weber River on the Brown’s Canyon Road, the landowners sought to restrict the public’s access to the Weber River’s beds and banks, thereby keeping the public from enjoying this contested resource.

“Our rivers are part of our heritage, and have been useful to all Utahans since statehood.” says USAC president Kris Olson. “They are ‘gifts of providence,’ our natural resource, and now in the case of this stretch of the Weber, secured for future generations.”

In recognizing the utility of log drives to determine navigability, the Court has opened the door to applying this standard to other similarly-sized and useful rivers throughout the state. USAC looks forward to discussions with state officials to address the status of these waters and to issue appropriate guidance on which ones are now open to public use.

The USAC expects a final ruling on the second of its lawsuits on appeal to the Utah Supreme Court, challenging the constitutionality of the Act in its entirety, in the near future.

Tippets: Snake River Hatchery, Canadian Mining Boom, Rethinking Salmon Conservation

  • An Idaho hatchery intended to help salmon populations might instead be pushing them closer to the brink. While a recent report from the Idaho Department of Fish and Game blames water chemistry, “Idaho Rivers United, an environmental group, blasted the report as more reasons for removing four dams on the lower Snake River that impede salmon.” Via AP News.

  • In this recent article in The Idaho Statesman, Rocky Barker examines the question of whether the conservation work being done for salmon is doing more harm than good. “What if the billions of human-raised fish rob food from native fish competing in the limited waters of damaged ecosystems? What if by focusing on creating more fish for people to catch and eat, we’ve simply pushed the weakened salmon closer to extinction?”

Tippets: Record Low Salmon in the Fraser, The Gar Wars, Fish Returning to the Sandy River   

  • It is estimated that a record low number of steelhead will return from the ocean to the Fraser River in 2017. “Mike Ramsay, assistant director of BC’s Fish and Game branch, said if management practices in the federally regulated commercial salmon fishery don’t change, Thompson steelhead may not be able to recover from low returns,” reports Ash Kelly of CBC News.
  • In a recent article on The Nature Conservancy, Matt Miller writes about the fight to protect native populations of alligator gar and the changing face of the species as a worthy game fish. “Even in mainstream outdoor publications, attitudes are changing,” writes Miller. “There are still articles that call gar ‘trash fish,’ of course. But it’s becoming increasingly likely to also find articles celebrating them.”
  • A decade after the Marmot Dam was removed on Oregon’s Sandy River, habitat has improved and fish populations are rebounding. “Thanks to a lot of hard work on the part of many dedicated individuals and a lot of collaboration,” says Todd Alsbury, ODFW district fish biologist for the Sandy, “we are starting to see some impressive results.” Via KTVZ.

Jack Charlton’s Personal Fly Reels Up for Sale

MidCurrent just got word that a set of very exclusive fly reels is for sale at The Angling Company in Key West, Florida. Jack Charlton began his career in precision aerospace machining in 1965 in the Los Angeles area and founded Charlton Outdoor Technologies in 1991.  The first Charlton fly reel was introduced in 1993, and Charlton continued making fly reels with painstaking care and precision and in very limited quantities until 2003. Charlton passed away in October 2011. Manchester, Vermont (November 9, 2017) – The Board of Trustees of the American Museum of Fly Fishing is  pleased to announce Sarah Foster as the Museum’s new Executive Director. A valued member of the AMFF team since 2007, Mrs. Foster brings a wealth of institutional knowledge to the position. She previously served as the Museum’s Director of Development.

Karen Kaplan, AMFF Board President said today, “Sarah is an AMFF staff veteran, highly respected by both the Trustees and staff, whose expertise will lead the Museum forward in a smart and positive way. We greatly welcome her as our new Executive Director.”

“2018 marks the Museum’s 50th anniversary which is honorable in its own right, but coupled with the launch of our anticipated saltwater exhibition and the creation of a new permanent fly room, we have set the stage for an exciting year. The Museum has a wonderful Board and loyal supporters locally, across the country, and around the world,” commented Mrs. Foster today from her office overlooking Main Street in Manchester Village. She went on to say, “The Museum is an important cultural landmark here in Vermont and also does a wonderful job serving the fly fishing community at large, and continues to be a place where angling historians, life-long enthusiasts, and new-comers alike can come together (either in person or online) to celebrate the rich history and tradition of our sport.”

Mrs. Foster is a graduate of the University of Albany and holds a Bachelor’s Degree in Anthropology and Business. She is a longtime resident of Shushan, New York where she lives with her husband and two children along the Battenkill River. She is an avid barrel racer and serves as treasurer at her local church.

Tippets: Bull Trout and Climate Change, Delaware River Shad, Salmon and Steelhead on the Snake River

  • Bull trout were added to the endangered species list in 1998 and since, have face a constant struggle to thrive and survive. “Today, the effects of climate change exacerbate the perils already facing threatened animals, and resources for protection are limited,” writes Stephen Miller. “The bull trout now serves as an early example of a new reality: The people charged with protecting what remains must make difficult decisions about what can be saved and what will be sacrificed.” Via The Sierra Club.
  • The number of juvenile shad in the Delaware River has risen to the highest in 38 years, reports The New Jersey Department of Environmental Protection,“indicating that water quality has improved and dams have been removed to allow many more of the fish to return to their spawning grounds.” NJ Spotlight.
  • A new document from federal fisheries managers reveals plans to restore salmon and steelhead runs without plans to remove hydroelectric dams along the Snake river drainage. “Critics say the workarounds are not addressing the core issue and ultimate solution through dam removal,” reports Jonathan Wright, “but the federal plan makes concessions that might be required in the future.” Via Fly Fisherman.
